5.1 Product Descriptions
PawsGoGo strives to provide accurate descriptions and images of our pet outdoor products. However, we do not warrant that product descriptions, colors, dimensions, or other content on the Service are entirely accurate, complete, reliable, current, or error-free. If a product offered by PawsGoGo is not as described, your sole remedy is to return it in unused condition.
5.2 Pricing and Payment
All prices are listed in the applicable currency and are subject to change without notice. The final price for an order will be confirmed at checkout and will include product costs, shipping fees, and applicable taxes (e.g., sales tax, VAT). You agree to pay all charges incurred by you or on your behalf through the Service, at the prices in effect when such charges are incurred.
For EU customers, prices displayed will include VAT where applicable, and shipping costs will be clearly indicated before the final purchase confirmation.
5.3 Order Acceptance
Your receipt of an order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline your order for any reason. We may require additional verifications or information before accepting any order.
5.4 Shipping and Delivery
PawsGoGo will arrange for shipment of the products to you. Delivery times are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs, or other factors beyond our reasonable control.
For international shipments (including to the EU), you are responsible for any customs duties, taxes, or import fees levied by the destination country. These charges are not included in the product price or shipping cost and are your sole responsibility.
5.5 Returns and Refunds
Our return policy allows for returns of unused products within a specified period (e.g., 14 days from delivery). For EU consumers, you have a statutory right of withdrawal of 14 days from the day you acquire physical possession of the goods, without giving any reason. 6. User-Generated Content (UGC)
PawsGoGo allows users to post reviews, comments, photos, and other content ("User Content"). You are solely responsible for your User Content and the consequences of posting or publishing it.
By submitting User Content, you grant PawsGoGo a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Service and PawsGoGo's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels.
You represent and warrant that:
•You own or have the necessary licenses, rights, consents, and permissions to use and authorize PawsGoGo to use all patent, trademark, trade secret, copyright, or other proprietary rights in and to any and all User Content to enable inclusion and use of the User Content in the manner contemplated by the Service and these Terms.
•Your User Content does not violate any third-party rights, including privacy rights, publicity rights, copyrights, trademark rights, contract rights, or any other intellectual property or proprietary rights.
•Your User Content does not contain any defamatory, libelous, hateful, violent, obscene, pornographic, unlawful, or otherwise offensive material.
PawsGoGo reserves the right to remove any User Content at its sole discretion, without prior notice.
7. Intellectual Property Rights
All content on the Service, including text, graphics, logos, images, audio clips, digital downloads, and software, is the property of PawsGoGo or its content suppliers and protected by international copyright, trademark, and other intellectual property laws. The compilation of all content on the Service is the exclusive property of PawsGoGo.
8. Disclaimers and Limitation of Liability
THE PAWSGOGO SERVICE AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE ARE PROVIDED BY PAWSGOGO ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. PAWSGOGO MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICE, OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE, UNLESS OTHERWISE SPECIFIED IN WRITING. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
TO THE FULL EXTENT PERMISSIBLE BY LAW, PAWSGOGO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. PAWSGOGO DOES NOT WARRANT THAT THE SERVICE, INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE, PAWSGOGO'S SERVERS, OR ELECTRONIC COMMUNICATIONS SENT FROM PAWSGOGO ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
IN NO EVENT SHALL PAWSGOGO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT PAWSGOGO HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
8.1 Pet Product Safety Disclaimer
PawsGoGo sells products designed for pets. While we strive to offer high-quality and safe products, it is the responsibility of the pet owner to ensure the suitability and safe use of any product for their specific pet. Always supervise your pet when using any product, especially new ones. Inspect products regularly for wear and tear. PawsGoGo is not responsible for any injury, damage, or loss resulting from the misuse or improper application of products purchased through our Service.
9. General Provisions
9.1 Entire Agreement
These Terms, together with the Privacy Policy and any other legal notices published by PawsGoGo on the Service, constitute the entire agreement between you and PawsGoGo concerning the Service.
9.2 Severability
